If credit is granted, I/We understand that the terms of sale are net 10th of

 the month following purchase. Statements are mailed at the end of each calendar month. Povia Paints, Inc. may charge interest on any past

due balance at the maximum rate allowed by law with said interest

being calculated from the date of default.

In consideration of Povia Paints, Inc. extending credit to the above business, I/We do hereby agree jointly and individually, to pay for all goods, wares, and merchandise supplied to me or to any of us or the above business. In the event that the account is placed with a third party for collection, I/We agree to pay all costs and expenses, including court costs, finance charges, and all reasonable attorney fees incurred in the enforcement of this agreement including without limitation appeals and/or the collection of sums due by suit or otherwise, prior and/or subsequent to a final judgment. I/We further agree that if it shall become necessary for Povia Paints, Inc. to bring an action against Me/us, then venue shall be in Lee County, Florida, and the provisions of Florida Law shall apply to all matters with respect to the construction of this contract.

I/We authorize Povia Paints, Inc. to investigate our credit history, bank performances and any information deemed necessary to extend credit. I/We agree to; (1), Immediately notify Povia Paints, Inc. in writing, delivered in person or by certified mail return receipt, of any change in ownership, form of business, change of address, or termination of a person’s authority to incur charges under the account of applicant; (2), Indemnify Povia Paints, Inc. for any loss incurred thereby as a result of our failure to provide said written notice. This agreement shall remain in full force and effect until written notice of revocation is received by Povia Paints, Inc.
